GAFSHUB — Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the GAFSHUB website, application, and related services (collectively, the “Service”).

The Service is operated and maintained by a volunteer collective of community members (“the GAFSHUB Volunteers,” “we,” “us,” or “our”).

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Service.

Agreement to Terms

GAFSHUB is a non-commercial, community-maintained platform operated entirely by volunteers. It is not a company, corporation, partnership, or incorporated organization, and does not operate for profit.

The volunteers provide and maintain the Service on a best-effort basis, with no warranties or guarantees regarding functionality, accuracy, legality, or availability.

Use of the Service is entirely at your own risk.

Conditions for Use of the Forum

Your permission to use the forum is subject to the following conditions:

  1. Minimum age. You must be at least eighteen (18) years old to use the forum. Certain activities—such as creating or participating in firearms listings—also require meeting the higher age threshold in Eligibility and Account Registration.
  2. Cease on notice. You may no longer use the forum if the GAFSHUB Volunteers contact you directly to say that you may not.
  3. Follow rules. You must use the forum in accordance with Acceptable Use and ensure your listings and posts meet the standards in Content Standards and User Content and Listings.

Nature of the Service

GAFSHUB is a peer-to-peer community and listing platform that enables users to connect to buy, sell, or trade firearms, ammunition, parts, and accessories in accordance with applicable laws.

We do not:

  • Broker, arrange, or participate in any transactions.
  • Collect, hold, or transfer any funds between users.

All exchanges, negotiations, and payments occur directly between users, who assume full responsibility for the legality and safety of their activities.

Compliance with Laws

Users are solely responsible for ensuring that their use of the Service complies with all applicable federal, state, and local laws governing firearms and related items, including but not limited to:

  • Background checks, licensing, and transfer requirements
  • Federal Firearms License (FFL) involvement where required
  • Restrictions on certain firearm types, magazines, ammunition, or accessories
  • Import/export, shipping, and carrier restrictions

We may remove listings or suspend users that appear to violate any law or regulation, but we make no guarantee of detecting or preventing illegal activity.

Eligibility and Account Registration

  • You must be at least 18 years of age (or the greater age required by law) to create an account involving firearms listings.
  • You must provide accurate and current information when registering.
  • We may require identity verification or documentation to confirm eligibility or compliance at any time.

Acceptable Use

To keep the forum safe and lawful—especially for firearms-related listings—you agree that:

  1. Obey the law. You may not break the law using the forum, including firearms, commerce, privacy, IP, and computer misuse laws.
  2. No unauthorized access. Do not use or try to use another user’s account without their permission.
  3. No trafficking in accounts. Do not buy, sell, or trade user names or unique identifiers.
  4. No spam or harvesting. Do not send advertisements, chain letters, or solicitations, or harvest user data.
  5. No abusive automation. Do not automate access (bots, crawlers, etc.) except for indexing publicly as a search engine you operate.
  6. No mass messaging. Do not use the forum to mass-email lists or groups.
  7. No false affiliation. Do not falsely claim endorsement by GAFSHUB or the Volunteers.
  8. No hotlinking. Do not hyperlink images or non-text content from other sites.
  9. No tampering. Do not remove proprietary marks or bypass security.
  10. No infrastructure strain. Do not overload the forum with excessive requests.
  11. No impersonation. Do not impersonate others.
  12. No enabling violations. Do not aid others in breaching these Terms.
  13. Firearms-specific. Do not use the forum to arrange, encourage, or instruct others on unlawful transfers or manufacturing, or to evade legal background-check, licensing, or FFL procedures.

Content Standards

You agree that content you submit (posts, messages, listings, media) will adhere to:

  1. Legality and safety. No illegal, violent, threatening, harassing, or hateful content.
  2. Rights and privacy. No violations of law, intellectual property, privacy, or contractual rights.
  3. No malicious code. Do not post malware, spyware, or similar.
  4. No placeholders or squatting. Do not post empty or placeholder content to reserve names or URLs.
  5. No unauthorized disclosure. Do not reveal private or confidential information without consent.
  6. Listing accuracy. Listings must be accurate, lawful, and not misleading, including true description and condition.
  7. No illegal modification guidance. Do not post instructions or content promoting illegal firearm modification or evasion of law.

Prohibited Conduct

You agree not to use the Service to:

  • Offer or request any item whose sale, possession, or transfer is prohibited by law
  • Attempt to sell or transfer a firearm without required background checks, licenses, or FFL procedures
  • Evade legal transfer requirements or engage in “off-the-books” transactions
  • Post false, misleading, or deceptive listings
  • Facilitate, encourage, or conspire to commit any unlawful act

Prohibited Items

Users may not list, offer, solicit, or trade any item that is prohibited by applicable law, or that would require a license or procedure the user is not authorized to perform. Prohibited items include, but are not limited to:

  1. Unlawful machine guns / fully automatic firearms

    • Defined under 26 U.S.C. § 5845(b); prohibited unless lawfully registered and transferable under the NFA.
    • Only pre-1986 transferable machine guns may be privately transferred where permitted.
    • Post-1986 dealer samples or post-samples may only be transferred between licensed FFL/SOT holders or government agencies.
    • Unregistered or non-transferable machine guns must not be listed.

  2. Unregistered or improperly registered NFA items
    Items regulated under the NFA (SBRs, SBSs, silencers, destructive devices, AOWs) may only be listed or transferred in full compliance with ATF procedures (Form 3/Form 4 with tax stamp).

  3. Unserialized or “ghost” firearms or unfinished frames/receivers where restricted by law.

  4. Explosives or prohibited ammunition, including explosive projectiles or armor-piercing handgun rounds.

  5. Illegal conversion devices, such as auto sears or Glock switches, unless permitted for licensed manufacturers.

  6. Stolen, altered, defaced, or counterfeit firearms or components.

  7. Any item whose sale, possession, or transfer violates applicable law.

Enforcement

The GAFSHUB Volunteers and moderators may investigate and act on violations of these Terms.

  • We may edit, redact, or remove any content or listings that violate these Terms or appear unsafe, unlawful, or misleading.
  • We may suspend or restrict accounts at any time for suspected violations, to protect users, or to comply with law.
  • We may notify or cooperate with law enforcement regarding activity believed to be illegal or threatening to public safety.
  • Enforcement actions may be taken without prior notice, at our sole discretion, and do not imply any duty to monitor or police user activity.
  • Users who repeatedly or seriously violate these Terms may be permanently banned.

Transactions Between Users

  • All communications, negotiations, and trades occur entirely between users.
  • The Volunteers do not process, hold, or guarantee payments and offer no escrow or mediation.
  • Each user is responsible for verifying identity, eligibility, and lawful status of others.
  • You assume all risk associated with meeting, transferring, or transacting with others.

No Fees or Financial Involvement

GAFSHUB charges no fees and collects no funds of any kind.

The Volunteers are not responsible for disputes, nonpayment, or fraud between users.

User Content and Listings

  • You retain ownership of content and photos you post but grant the Volunteers a limited license to display them for operating the Service.
  • Listings must be accurate, lawful, and not misleading.
  • The Volunteers may remove or modify any listing at any time for any reason.

Disclaimers

The Service is provided “as is” and “as available.”

We do not:

  • Verify user identities or ownership.
  • Endorse or guarantee any user, listing, transaction, or item.
  • Provide any warranty, express or implied, regarding legality, accuracy, or safety.

You accept all risk of using the forum and content on the forum. As far as the law allows, the Volunteers provide the forum as is, without any warranty whatsoever.

The forum may hyperlink to or integrate services run by others. GAFSHUB does not make any warranty about those services or their content.

Limitation of Liability

Because GAFSHUB is maintained by unpaid volunteers and not a business entity, the Service is provided on a voluntary, non-professional basis.

To the fullest extent permitted by law:

  • The Volunteers shall not be liable for any loss, injury, damage, or death arising from use of the Service.
  • The Volunteers are not responsible for any user’s failure to comply with firearms laws or safety practices.
  • The total liability of all Volunteers collectively shall not exceed $100 in any case.

Indemnification

You agree to indemnify and hold harmless the GAFSHUB Volunteers, administrators, and moderators from any claims, damages, or losses (including reasonable attorneys’ fees) arising from:

  • Your use of the Service
  • Any item you list, sell, or purchase
  • Your violation of any law or regulation
  • Your breach of these Terms

Reporting and Law Enforcement Cooperation

The Volunteers may suspend, remove, or report accounts or listings involving illegal activity or safety risks.

We will cooperate with legitimate law-enforcement requests or subpoenas as required by law.

Termination

The Volunteers may suspend or terminate access to the Service at any time, for any reason, without notice.

Upon termination, your right to use the Service immediately ceases.

Privacy

Please review our Privacy Policy or details about how user information may be collected, used, and protected.

Governing Law and Disputes

These Terms are governed by the laws of the United States of America, without regard to its conflict-of-law principles.

Any disputes shall be resolved in a competent court of jurisdiction reasonably connected to the operation of this site, unless otherwise required by applicable law.

Modifications

The Volunteers may update or modify these Terms at any time by posting a revised version on the Service.

Continued use after posting constitutes acceptance of the updated Terms.

General Terms

If a provision of these terms is unenforceable as written, but could be changed to make it enforceable, that provision should be modified to the minimum extent necessary to make it enforceable. Otherwise, that provision should be removed.

You may not assign your agreement with the Volunteers.

The Volunteers may assign your agreement to an affiliate, successor, or organization that continues operating the forum.

Any attempted assignment against these terms has no legal effect.

Neither the exercise of any right under this Agreement, nor waiver of any breach of this Agreement, waives any other breach.

These terms embody all the terms of agreement between you and the Volunteers regarding use of the forum and replace any previous agreements.
